PRIVACY POLICY IN EFFECT AS OF 01/01/2022

This document, to which the General Terms and Conditions of Use of the website https://mauriceauction.com (hereinafter the "Site") refer, aims to inform you about our practices for processing and protecting your personal data, as defined below. We invite you to carefully read all the information we provide and if you have any questions, please contact us.

1. Definitions

"Data" refers to all information allowing the direct or indirect identification of an individual through a reference to an identification number or one or more elements specific to them. You will never be asked to provide personal data that is considered "sensitive," such as your racial or ethnic origins, political, philosophical, or religious opinions, or information about your income or tax situation.

Your data is only collected for the strict use and understanding of the Site and its Services, as well as the purposes described in Article 4.

The Sales Operator acts as the controller of your data, which is collected when using the Site to provide you with the Services. This means that the Sales Operator is responsible for their collection, security, and use for purposes described herein in compliance with data protection rules. The Sales Operator does not rent or sell its customer files to third-party commercial companies unrelated to the Services defined in the General Terms and Conditions of Use of the Site.

"Newsletter" refers to an informational, promotional, or advertising email sent by the Sales Operator to Users who have provided their contact information for the performance of the Sales Operator's Services.

"Services" refers to all services offered by the Sales Operator on the Site and described in Article 3 of the General Terms and Conditions of Use.

2. Consent

By using our Services, you agree to provide truthful information about yourself, and you understand and accept that your data may be collected, used, stored, and transmitted to third parties as described below for the purposes of providing the Services you wish to benefit from. 3. Data Collection

We may collect the following categories of data:

a. Site Navigation

Connection Data. Each time you log on to the Site, we passively collect information such as your computer's IP address, the date and time of connection, and information about your browser. Navigation Data. We also collect information to identify how you access the Site, which pages are viewed, and for how long. We may use Cookies, as specified below.

b. Purchase Orders and Telephone Bids and Online Estimate Requests

When you place a Purchase Order or a Telephone Bid, or when you request a free online estimate, we collect certain information such as your name and surname, postal address, email address, phone number, date of birth, as well as the history and details of your purchases, and the number and amounts of your bids. This information is required by the Sales Operator to comply with the formal identification obligation of its customers, which it is subject to in the context of anti-money laundering, among other things.

c. Subscription to a Newsletter

In accordance with the General Terms and Conditions of Use, when you subscribe to a Newsletter on the Site, you will be asked to provide a certain amount of data, including your name and surname, postal address, email address, phone number, date of birth, etc. This information is required by the Sales Operator to send you newsletters corresponding to your desired specialties of objects and sales.

d. Bank Data

When you pay an auction bill online, your bank data is requested to ensure payment of your bill or guarantee your participation in the auction sale. When you make a deposit, your data is requested to guarantee your payment of a lot in case of an auction in your favor. The Sales Operator may decide to deduct the deposited amount before the sale as a guarantee pending your complete payment. However, this data is transmitted directly to the Sales Operator's payment provider, the certified company Ingenico certified PCI-DSS. This standard is an international security standard whose objectives are to ensure the confidentiality and integrity of cardholder data, thus securing the protection of card and transaction data.

When you place a Purchase Order or a Telephone Bid request on the Site, your banking data is requested by the Sales Operator to verify the validity of your bank account. However, this data is only kept for the duration of the auction.

4 - Purposes of collecting your data

Your Data is collected to allow us to provide you with the Services and to fulfill one or more of the following purposes: -Enable the use of the Site, -Provide a history of placed Purchase Orders and Telephone Bids, -Ensure the proper execution of transactions initiated by Users such as Purchase Orders and Telephone Bids, -Provide a free appraisal service for offered goods; -Offer an efficient customer service, particularly in terms of Site usage assistance and complaint management, -Create a database of Users, customers, and prospects, -Send Newsletters, solicitations, and promotional messages based on selected preferences among the offered object categories, -Develop commercial and internal traffic statistics of the Services, -Manage any disputes regarding the use of the Services and the Site, -Combat fraud, -Manage your requests for access, correction, and opposition to the collection of your Data, -Comply with our legal and regulatory obligations.

We inform you, during the collection of your Data, if certain Data must be provided or if it is optional. If you do not fill in these mandatory fields, you will not be able to access the Services.

Subscription to our Newsletter is done by checking a box on the corresponding Site page.

It is possible to unsubscribe from Newsletters at any time by clicking on the unsubscribe link at the bottom of received emails.

In case of malfunction of the unsubscribe link, you can unsubscribe by sending a message to the address listed in Article 13.

5. Data Recipients

a. Our Service Providers

We share your data with our own service providers located within the European Union, notably to carry out services and actions at your request and on our behalf, such as verifying the validity of your phone number, sending promotional and marketing emails or SMS, or managing your transactions. We use and process your connection data to identify, delimit and remove malfunctions and errors in telecommunication systems. We may also use connection data to detect any illegal use of telecommunication systems and services.

b. Judicial Authorities

In accordance with applicable legal provisions, the Sales Operator may be required to provide information to competent authorities and courts for the purposes of criminal proceedings. The Sales Operator may not inform you of the disclosure of your data to authorized third parties. Data Retention Period We only keep your data for the period necessary to carry out our services and for up to three (3) years after your subscription to the Newsletter.

At the end of this three (3) year period, the Sales Operator may contact you to ask if you wish to continue receiving information about the Sales Operator's products and services. In the absence of positive and explicit action on your part, the data concerning you will be archived or deleted in accordance with applicable legal provisions.

In the event of a breach of the General Terms and Conditions of Use or this Privacy Policy, the Sales Operator reserves the right to refuse access to the Site's Services under the conditions described in the General Terms and Conditions of Use.

In accordance with article L.123-22 of the French Commercial Code, the Sales Operator archives the entire data of successful bidders for ten (10) years from the end of the contractual relationship for billing and accounting management.

Similarly, the data of successful bidders is archived for a period of five (5) years from the end of the contractual relationship in the context of contracts between traders and non-traders or between traders in accordance with article L.110-4 of the French Commercial Code. In accordance with article 213-1 of the French Consumer Code, this period may be extended to ten (10) years when the contract is concluded electronically with a consumer and the amount is equal to or greater than 120 euros, and the Sales Operator guarantees access to the successful bidder at any time upon request.

At the end of this period, the Sales Operator undertakes to delete or anonymize the data it holds.

7. Security

We have implemented technical and organizational security measures to ensure the security, integrity, and confidentiality of all your data to prevent them from being lost, stolen, damaged, altered, or distributed to unauthorized persons.

We store your data on servers located within the European Union.

8. Cookies

9. User Rights

The data provided is necessary for the performance of the Services to which you have subscribed. Therefore, you cannot withdraw your consent to the processing of the data necessary for the performance of the Service, unless you stop using the Services. However, you can consult, modify, or request the deletion for legitimate reasons of your Data at any time using the contact information provided in Article 13 below. The Sales Operator provides information on the measure taken within one (1) month from your request. Requests for limiting processing or portability of Data are made under the same conditions. However, this one (1) month period may be extended by two (2) months, subject to having informed you of the reasons for the extension within the one (1) month period. You may also object at any time to the processing of your Data to which you have previously specifically consented for prospecting purposes. The Sales Operator provides you with information on the Data stored about you free of charge. Information can be provided electronically if you wish. For your security, please understand that in the event of a request for information or modification, we must verify your identity. Your identity document will not be kept following your request. The Sales Operator undertakes to inform all recipients of the Data processing of your request.

10. Data management after death

You have the right to specify with your explicit consent directives concerning the storage, deletion, and communication of your data after your death. You may modify or revoke these directives at any time.

You may appoint a person to execute your directives. This person will have the authority, upon your death, to access your directives and request their implementation from the Sales Operator. If no one is designated or in case of the designated person's death, your heirs will have the authority to access your directives and request their implementation from the Sales Operator, unless stated otherwise.

In the absence of directives or contrary indications in your directives, your heirs may exercise your rights to:

  • Organize and settle your estate. Your heirs may access data processing related to you to identify and obtain useful information for the settlement and distribution of the estate. They may also receive communication of digital assets or data similar to family memories, transferable to heirs.
  • Notify the Sales Operator of your death. Your heirs may object to the continuation of data processing concerning you or request their update.

Upon request from your heirs, the Sales Operator must justify, at no cost to the requester, having carried out the operations required by the heirs. Disagreements between heirs regarding the exercise of these rights will be brought before the competent court.

11. Modification of privacy policy

The Sales Operator reserves the right to modify the Privacy Policy at any time, which remains applicable during the entire period of use of the Site and Services. In case of modification, the Sales Operator will inform you by email.

If you refuse these modifications, you agree to stop using the Services. Otherwise, your use of the Services is subject to the terms of the new version of the Privacy Policy. Any modification or removal of the Services does not entitle you to any compensation whatsoever.

When this data is only kept for evidentiary purposes, it must be archived to no longer appear in active databases and only be accessible to authorized personnel due to their function.
